By what right under Islamic Law does Al-Baghdadi make himself Caliph? Is he a descendant of Muhammad? Is he an Umayyad or an Abbasid or an Ottoman? So how can he claim to be the Caliph?

His assumed sobriquet al-Husseini al-Hashimi al-Qurashi makes a claim to be a descendent of Muhammad via Ali's son Husayn. But as this was not part pf his original name, it seems to be fabricated.

The caliphate is not supposed to be dynastic. It is acquired by acknowledgement by the majority of Muslims. This clearly he does not have, but since ISIL does not consider Muslim those that agree with them anyway they won't care.
